Argentina announced citizenship by investment on 2 October 2026, with a non-refundable US$350,000 Treasury contribution or a US$800,000 public-bond subscription for a main applicant. The Ministry of Economy says applications will open during the fourth quarter of 2026, but the implementing rules have not yet been published in the Boletín Oficial.
Economy Minister Luis Caputo and Chief of Cabinet Diego Santilli presented the program at the Argentine Embassy in Paris. Our news report sets out what was announced. This analysis examines five questions whose answers could change an applicant’s decision.
1. Does the decree behind the program survive in court?
This is the largest open question. The program is built on DNU 366/2025, which amended Citizenship Law 346 so that a relevant investment qualifies a foreigner for naturalization whatever their time of residence. On 30 June 2026 the Cámara Nacional Electoral declared that decree null in "Yang, Liping s/ nacionalidad y ciudadanía". It reasoned that citizenship is tied to political rights and that article 99, subsection 3 of the Constitution forbids the president to regulate electoral matters by decree, La Nación reported.
The government said the ruling was not final and that it would go to the Supreme Court, La Nación reported on 1 July. Lawyers disagree on the reach of the June ruling. Some say the DNM can no longer grant naturalization. An analysis published by Comercio y Justicia on 17 September argues that the nullity binds only the Yang case and the decree remains in force for others. The Supreme Court has not ruled on DNU 366/2025. Its 29 September ruling concerned DNU 70/2023 and rural land, not citizenship.
The rulings reported so far do not address the investment route specifically. That route has the same legal parent and finishes with a decision by the Dirección Nacional de Migraciones (DNM), so the final outcome of the dispute matters to it. A Supreme Court judgment or a law passed by Congress would settle the matter. Until then the risk sits with the applicant, who would be committing money to a program whose legal basis courts have questioned. Independent legal advice on this point belongs at the start of any decision, not the end.
2. What exactly is the bond?
The US$800,000 option is a subscription to a public bond created for the program. Caputo called it a zero-rate bond, Bloomberg Línea reported. Unlike the Treasury contribution, a bond subscription would in principle return the capital at maturity, which is the difference from the non-refundable US$350,000 contribution. Bloomberg Línea has reported a seven-year term, but the official terms have not been published. The government has not published how long the money would be tied up, whether the bond can be sold or transferred before maturity, and what happens to the subscription if citizenship is refused.
Those are not footnotes. A zero-rate bond pays no interest, so the investor gives up whatever the money could have earned elsewhere over the term. Without the maturity the two options cannot be compared fairly, and the refusal terms decide who carries the risk of a rejected application. Decreto 524/2025 sets no minimum amount, so the bond terms and the US$350,000 figure will have to be fixed in a Ministry of Economy resolution or Agency rule, and none had been found in the Boletín Oficial as of 2 October.
Real estate purchases are not among the announced qualifying options.
3. What will it cost in total?
The headline numbers are contributions and a bond subscription, and an all-in cost cannot yet be calculated. Government fees, due diligence fees and professional fees have not been published. Family members would make additional Treasury contributions:
- spouse: US$100,000;
- children aged 18 to 25 who are unmarried and have no children of their own: US$100,000 each;
- children under 18: US$25,000 each.
The family example in the announcement, US$500,000 for a main applicant with a spouse and two minor children, uses the US$350,000 route and counts only Treasury contributions: 350,000 plus 100,000 plus two payments of 25,000. A child aged 18 to 25 who is unmarried and has no children of their own would add US$100,000, not the US$25,000 charged for a child under 18.
Until the government publishes its fees and due diligence charges, a private party’s all-in price should not be mistaken for an official fee schedule. Paying does not guarantee citizenship: the Agency evaluates applications with SIDE, the UIF and the Ministries of Security and of the Interior. Checks cover identity, source and traceability of funds, assets and net worth, jurisdictional risk, criminal and reputational background, and migration history. Money must pass through the formal financial system under anti-money-laundering and counter-terrorist-financing rules.
4. Do applicants have to live in Argentina, or even visit?
DNU 366/2025 provides that the investment route applies "cualquiera sea el tiempo de residencia", whatever the time of residence, so the decree itself requires no minimum stay. That is the central difference from ordinary naturalization, which since the same decree requires two years of legal, continuous residence with no trips abroad, and which faces the same legal challenge.
What the announcement does not say is whether applicants must attend in person, for biometric data or an oath, or whether any obligations follow approval. Those points depend on the Agency's complementary rules, which have not been issued. Vetting will include migration history. A residence-time exemption does not resolve the separate question of in-person attendance.
Four different things are easy to confuse:
- citizenship by investment, a form of naturalization and the subject of this program;
- the investment-based residence categories under the migration law (Ley 25.871), which grant residence, not citizenship;
- ordinary naturalization after two years of legal, continuous residence;
- RIGI, the large-investment incentive regime for companies, which is not a citizenship route.

5. When can people apply, and under which rules?
The Ministry's only timing is the fourth quarter of 2026. No date, portal or form exists yet in the public record. An application goes to the Agency, which evaluates whether the investment qualifies as relevant under Ministry of Economy criteria and requests background reports. It sends a reasoned recommendation to the DNM. Decreto 524/2025 gives the DNM 30 business days from receiving the Agency's final report to decide by a reasoned act. ARCA is to enable a CUIT tax identification number for the new citizen. The Agency stage has no published deadline, so a prospective applicant cannot yet estimate the total time.
The rules that would give the announcement legal force are also pending. The decree leaves it to the Ministry of Economy to define what counts as a relevant investment and to the Agency to issue the complementary rules. Decreto 285/2026, published on 28 April 2026, appointed Aixa Granara as the Agency’s executive director ad honorem, effective 22 April, but a Ministry tender to hire an outside program designer was suspended by Resolution 522/2026 on 14 April, La Nación reported.
What to watch
Three signals will show whether the announcement becomes a working program:
- a Ministry of Economy resolution and Agency rules in the Boletín Oficial, with amounts, bond terms, fees, documents and procedure;
- a Supreme Court ruling on DNU 366/2025, or a law passed by Congress giving the program a statutory basis;
- the opening of applications in the fourth quarter, if it happens on schedule.
The Ministry says the money will go toward strengthening the country’s fiscal and financial position. The amount raised will depend on applications and approvals once the program opens; the announced contribution amounts alone cannot show what it will raise.
